If you have an accident whilst travelling on an aeroplane, your position is
covered by the Amended Warsaw Convention, as set out in Schedule 1A
to the Carriage by Air Act 1961. This will provide that you will be able to
recover damages for an accident onboard an aircraft and in most
circumstances you will not have to prove fault.
In our experience, the most common accidents on aircraft result from
luggage falling onto unsuspecting passengers and the spilling of hot
liquids on passengers whilst in the air. Occasionally, there can be
slip/trips.
The limitation period for bringing such claims is that they must be
brought within 2 years of the date of the incident. We will be able to
